Bits42 Internet Technologies Private Limited ("Bits42", "we", "us", or "our") operates https://studiomode.ai/ and the StudioMode service (the "Platform"). This Privacy Policy explains how we collect, use, disclose, store, and protect your personal data when you visit or use the Platform.
This Policy is issued in compliance with the Digital Personal Data Protection Act, 2023 ("DPDP Act"), the Information Technology Act, 2000, the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, and other applicable Indian laws. By using the Platform, you confirm that you have read and understood this Policy.

2. Personal Data We Collect
2.1 Information You Provide Directly
- Account Information: name, email address, phone number, password (stored in hashed form), profile picture, business name.
- Billing Information: billing address, GSTIN (if applicable), payment instrument metadata returned by our payment gateway. We do not store your full card number, CVV, or net-banking credentials.
- Communications: messages, support tickets, and feedback you send to us.
- User Content: photographs, videos, prompts, brand assets, and other materials you upload to generate Output.
2.2 Information Collected Automatically
- Device & Technical Data: IP address, browser type and version, device identifiers, operating system, language, and time zone.
- Usage Data: pages viewed, features used, generation counts, click-through events, error logs, and timestamps.
- Cookies & Similar Technologies: see Section 8.
2.3 Information from Third Parties
- Authentication providers (e.g., Google Sign-In) if you use them to register or log in.
- Payment processors that confirm transaction status.
- Analytics, marketing, and anti-fraud service providers.
3. Purposes of Processing
We process personal data for the following lawful purposes:
- Providing and operating the Service, including running AI models on your inputs to produce Output.
- Authenticating users and securing accounts.
- Processing payments, issuing invoices, and complying with GST and tax obligations.
- Communicating service announcements, updates, and security notices.
- Providing customer support and responding to queries.
- Improving and developing the Service, including model performance evaluation in aggregate or de-identified form.
- Detecting and preventing fraud, abuse, and breach of these Terms or law.
- Marketing and promotional communications, where you have provided consent or where permitted by law (you can opt out at any time).
- Complying with legal, regulatory, and law-enforcement obligations.
4. Legal Bases (DPDP Act)
We rely on the following grounds under the DPDP Act:
- Consent: For optional purposes such as marketing emails. You may withdraw consent at any time.
- Legitimate Uses: For purposes such as performance of our contract with you, responding to your requests, complying with law, and protecting against fraud.
5. How AI Models Use Your Inputs
By default, we do not use your User Content or Output to train our generative models for the benefit of other customers.
We may use de-identified, aggregated metrics (e.g., counts, error rates) to monitor and improve the Service.
Some generation tasks are routed to third-party AI infrastructure providers under contractual data-protection commitments. These providers process inputs only to return the requested Output and as required by law.
6. Sharing & Disclosure
We do not sell your personal data. We may share personal data with:
- Service Providers / Data Processors: cloud hosting (e.g., AWS, Google Cloud), payment processors, email/communication providers, analytics, customer-support tools, and AI model providers, all bound by appropriate confidentiality and data-protection terms.
- Professional Advisors: lawyers, auditors, accountants, and consultants under confidentiality.
- Authorities: government, regulatory, or law-enforcement agencies where disclosure is required by law, court order, or to protect our or others' rights and safety.
- Corporate Transactions: in connection with a merger, acquisition, restructuring, or sale of assets, with appropriate confidentiality obligations.
7. International Transfers
Some of our service providers may be located outside India. Where personal data is transferred outside India, we ensure that such transfers comply with the DPDP Act and any restrictions notified by the Central Government, and that recipients are bound by reasonable data-protection commitments.
8. Cookies & Similar Technologies
We use cookies and similar technologies to authenticate sessions, remember preferences, measure usage, and support marketing. You can control cookies through your browser settings; disabling certain cookies may impact Platform functionality. Where required by law, we will request your consent for non-essential cookies through a cookie banner.
9. Data Retention
- Account data is retained while your account is active and for a reasonable period thereafter to comply with legal, tax, accounting, or audit requirements.
- Uploaded User Content and generated Output are retained as long as your account is active or until you delete them, subject to backup retention windows of up to ninety (90) days.
- Logs and security data are typically retained for up to twelve (12) months.
- Tax and financial records are retained for at least eight (8) years as required by Indian tax law.
10. Your Rights
Subject to applicable law, including the DPDP Act, you have the right to:

- Access and obtain a summary of personal data we process about you.
- Correct, complete, update, or erase inaccurate or incomplete personal data.
- Withdraw any consent you previously gave (this will not affect the lawfulness of prior processing).
- Nominate another person to exercise rights in the event of your death or incapacity.
- Grievance redressal in respect of any act or omission regarding your personal data.
11. Security
We implement reasonable security practices and procedures consistent with the IT (Reasonable Security Practices) Rules, 2011 and ISO/IEC 27001-aligned controls, including encryption in transit (TLS), encryption at rest where applicable, role-based access controls, audit logging, vulnerability management, and personnel training. No system is completely secure, however, and we cannot guarantee absolute security.
12. Children
The Platform is not directed at children under 18 years of age. We do not knowingly collect personal data from children. If you believe we have collected such data, please contact us at info@bits42.in for prompt deletion. Where the DPDP Act applies, processing children's data requires verifiable parental consent and is subject to additional restrictions, including a prohibition on tracking, behavioural monitoring, and targeted advertising directed at children.

The Platform may contain links to third-party sites and services. This Policy does not apply to those services. Please review their privacy notices.
14. Updates to This Policy
We may update this Policy to reflect changes in our practices, technology, or legal obligations. Material changes will be notified via email or in-Platform notice. The "Effective Date" at the top reflects the date of the most recent revision.
